By using our services (“Services”), you agree to these Terms of Service (“Terms”). These Terms apply to all services provided by VultrexHosting (“We”, “Us”, “Our”) to you (“Client”, “You”, “Your”), including but not limited to game servers, VPS hosting, dedicated servers, and any additional products or services.
We reserve the right to modify these Terms at any time. The version published on our website at the time of your order is binding. Continued use of our Services after any changes means you accept the updated Terms.
When registering, you confirm that all information you provide is accurate, current, and complete. We may request additional verification if necessary. Providing false or incomplete information may result in suspension or termination of your Services.
Your service will be activated once the payment has been processed (if applicable). You are responsible for timely payment of all fees due. Failure to pay on time gives us the right to suspend or terminate your service.
Our services are delivered digitally and become available immediately after payment or activation. Because the service starts immediately upon purchase, you explicitly waive your 14-day right of withdrawal under EU consumer law when placing your order. This means that refunds or returns are not possible once the service has been activated or started.
In exceptional situations, such as a technical fault on our side or unforeseen circumstances, a partial or full refund may be considered. In such cases, please contact us within 7 days of service activation. We reserve the right to determine whether a refund is warranted.
Any disputes or complaints about the service must also be reported within 7 days of activation. We aim to resolve all issues fairly and reasonably.
Cancellations must be submitted in writing or via email. If the service has already started or resources have been allocated, we reserve the right to charge for the work already performed or the reserved capacity.
We do not use subscription contracts. Payment is only possible on a monthly, quarterly, semi-annual, or yearly basis. This means you are never locked into a recurring payment agreement. Once a payment period expires and no renewal payment has been made, your server will be suspended until payment is received. If payment is not made within 3 months, the server and all associated data will be permanently deleted from our system.
You agree to use our Services only for lawful purposes and in compliance with these Terms and all applicable laws and regulations.
Prohibited activities include, but are not limited to: spam or bulk mailing, denial-of-service (DoS/DDoS) attacks, unauthorized access to networks or systems, hosting content that is discriminatory, pornographic (especially involving minors), infringing, or otherwise illegal, and using the service as an unlawful relay or proxy.
Violation of this Acceptable Use Policy (AUP) may result in immediate suspension or termination of your service without refund.
We provide the service as described in the product and order details. We strive to maintain high availability but do not guarantee uninterrupted operation. If a Service Level Agreement (SLA) applies, your sole remedy for deviation is limited to the compensation specified in that SLA, if any.
We are not responsible for downtime or reduced performance caused by circumstances beyond our control, including but not limited to upstream network issues, DDoS attacks, maintenance, force majeure, or your own usage or configuration.
We may suspend or terminate your service and/or account if you materially breach these Terms and fail to correct the issue within 2 calendar days of written notice from us. Upon termination, you remain responsible for any outstanding fees and are not entitled to refunds for amounts already paid.
Upon termination, it is your responsibility to back up and secure your data. Once your service is terminated, access to your data or authentication accounts may be lost, and we are not obligated to retain or recover any data.
Unless required by law, all services are provided “as-is” without any express or implied warranties. We are not liable for indirect damages, loss of income, lost profits, reputational damage, or data loss. In all cases, our total liability shall not exceed the amount you have paid to us for the affected service within the past 12 months.
All rights, titles, and interests in the products, services, software, documentation, and platform we provide remain with us or our licensors. You are granted only a limited, non-transferable license to use the service in accordance with these Terms.
We reserve the right to modify, upgrade, or discontinue any part of the service. If such a change materially affects your use of the service, you may terminate the service within 30 days of notification and request a pro-rated refund for any unused prepaid period, if applicable.
We process your personal data in accordance with our Privacy Policy, which forms an integral part of these Terms.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full effect. Failure by us to enforce any provision does not constitute a waiver of that right. These Terms are governed by the laws of Netherlands, and any disputes shall be submitted exclusively to the competent court in Amsterdam.
